DMCA Copyright Policy

Hinweis / Note: This page is mostly in English because it addresses international rights holders (the DMCA is US federal law). A short summary follows at the end.

1. Notice and Takedown

Schambereich is an online service provider as defined in 17 U.S.C. § 512 (Digital Millennium Copyright Act, DMCA). We provide a platform on which users can upload, store, and display pictures and stories. We take copyright infringement seriously and will act expeditiously upon receipt of a valid DMCA notification.

To file a DMCA take-down notice, please send a written communication containing substantially the following information (17 U.S.C. § 512(c)(3)):

  • A physical or electronic signature of the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed (or a representative list, if a single notification covers multiple works).
  • Identification of the allegedly infringing material with enough detail to allow us to locate it. Please include the full URL(s) of the page(s) where the material appears.
  • Your contact information: full legal name, postal address, telephone number, and e-mail address.
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner of the exclusive right allegedly infringed.

3. Counter-Notification

If you believe that material you posted was removed by mistake or misidentification, you may file a counter-notification (17 U.S.C. § 512(g)) containing:

  • Your physical or electronic signature.
  • Identification of the material that was removed, and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your full name, address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located — or, if outside the United States, any judicial district in which the service provider may be found — and that you will accept service of process from the original complainant.

Upon receipt of a valid counter-notification, we may restore the removed material in 10 – 14 business days unless we first receive notice from the original complainant that they have filed a court action.

4. Repeat-Infringer Policy

In accordance with 17 U.S.C. § 512(i), we will terminate the accounts of users who are repeat copyright infringers. A user generally will be considered a repeat infringer after two confirmed valid DMCA notices against their uploads.

5. Misrepresentation

Please note: under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing — or that material was removed by mistake — may be liable for damages, including costs and attorneys’ fees. Do not file false claims.
